ASCRS Access to and Use of Works Policy

To further its educational and scientific purposes, the ASCRS makes many of the Works created by its Volunteers available for use on the ASCRS Website. Some Works are publicly available on the ASCRS Patient Resource Library, and others are available to ASCRS [Fellows/members] on the ASCRS Members Only Resource Library. The Executive Council, or its designees, will determine, on a case-by-case basis, the scope of use and availability of individual Works.
 
The following rules apply to Works published on the ASCRS Patient Resource Library and the ASCRS Members Only Resource Library:
 

(i)         Each Work will acknowledge the contributions of the Volunteers who created it.
 
(ii)        Each Work will include a copyright notice and the following disclaimer statement:


The American Society of Colon and Rectal Surgeons (“ASCRS”) has prepared this Work solely for educational purposes. It is not medical advice or intended to replace the judgment of a licensed physician. To the extent permissible under applicable laws, the ASCRS is not responsible for any claims related to procedures, professionals, products, or methods referenced in the Work, and it does not approve or endorse any products, professionals, services or methods that might be referenced.
 
(iii)       Any ASCRS [Fellow/member] wishing to access, download, modify, and/or otherwise use a Work on the ASCRS Members Only Resource Library must agree to the following:
 
(a) [Fellow/Member] will use the Work only for educational purposes.
 
(b)  In downloading, modifying, or otherwise using the Work, [Fellow/Member] will not alter the notice of copyright or acknowledgement of the Volunteers’ contribution and will include the following disclaimer statement in any published version:

Access Agreement
 
In consideration for the opportunity afforded me by the American Society of Colon and Rectal Surgeons (“ASCRS”) to access, download, modify, and otherwise use one or more digital images, handouts, slide presentations, or other content available on the ASCRS Members Only Resource Library, I hereby agree to the following terms and conditions:
 
RULES
 
1.         I will use the Work(s) only for educational purposes.
 
2.         In downloading, modifying, or otherwise using the Work(s), I will not alter the notice of copyright or acknowledgement of the Volunteers’ contribution and will include the following disclaimer statement in any published version:

4.         I will indemnify and hold harmless the ASCRS, its officers, directors, members, volunteers, and sublicensees from and against any and all claims, actions, expenses, and liabilities arising from my negligence or willful misconduct in the use of the Work(s) or from the breach of any of my obligations as set forth herein.
 
AVAILABILITY OF RESOURCES
 
1. The ASCRS will deny access to the ASCRS Members Only Resource Center to any [Fellow/member] who does not agree to the terms of this Access Agreement and reserves the right to terminate access to any [Fellow/member] who does not abide by such terms.     
 
2. The ASCRS is under no continuing obligation to maintain specific Works on the ASCRS Members Only Resource Library and may update or remove any Work at any time.
 
LIMITATION OF LIABILITY
 
The Works on the Resource Center are intended solely for educational purposes. They do not constitute medical advice and are not intended to replace the judgment of a licensed physician. The ASCRS assume no responsibility or liability regarding the use of misuse of the Works for any purpose. To the extent permissible under applicable laws, the ASCRS is not responsible for any claims related to procedures, professionals, products, or methods referenced in the Works, and it does not approve or endorse any products, professionals, services or methods that might be referenced. In addition, the ASCRS makes no warranty that the ASCRS Members Only Resource Center, or any computer, server, device, software, or other technology associated with the Resource Center, is free of viruses, worms, or other elements or codes that manifest contaminating or destructive properties.
 
AMENDMENT
 
The ASCRS reserves the right to modify the rules of this Access Agreement as it determines from time-to-time in the best interests of the ASCRS, provided all [Fellows/members] are notified prior to such change.
